In recent years, feminist scholarship on emotional labor has proliferated. I identify a related but distinct form of care labor, hermeneutic labor. Hermeneutic labor is the burdensome activity of: understanding and coherently expressing one’s own feelings, desires, intentions, and movitations; discerning those of others; and inventing solutions for relational issues arising from interpersonal tensions. I argue that hermeneutic labor disproportionately falls on women’s shoulders in heteropatriachal societies, especially in intimate relationships between women and men. I also suggest that some of (...) the gendered burdens of emotional labor that feminist scholars point out would better be described as hermeneutic labor. Drawing on feminist philosophy as well as findings from social psychology and sociology, I argue that the exploitation of women’s hermeneutic labor is a pervasive element of what Sandra Bartky calls the ‘micropolitics’ of intimate relationships. The widespread expectation that women are relationship maintenance experts, as well as the prevalence of a gendered demand-withdraw pattern of communication, leads an exploitative situation to appear natural or even desirable, even as it leads to women’s dissatisfaction. This situation may be considered misogynistic in Kate Manne’s sense, where misogyny is a property of social environments rather than a worldview. (shrink)

The essay has been written to contribute to the debate on Dooyeweerd’s social philosophy. The goal is to argue that the central focus of his social philosophy is the “problem of order,” not communitarian issues. This article emphasizes that Dooyeweerd’s social theory was not oriented by communitarian concerns, but in comprehending the relation between creational order and social order.

O objetivo do presente artigo é comparar as perspectivas de Friedrich von Hayek e Hannah Arendt sobre a relação entre liberdade e política. A perspectiva de Hayek é chamada de liberdade da política devido a seu pessimismo quanto à capacidade da ação política estatal ampliar a liberdade individual. E a perspectiva de Arendt é chamada de liberdade na política devido a sua aceitação positiva do espaço político enquanto campo para o exercício da ação e da liberdade dos indivíduos. A conclusão (...) é que a liberdade na política pressupõe alguma liberdade da política, mas não se contenta com a liberdade negativa. A concretização da liberdade exige participação nos assuntos públicos e vida ativa na esfera pública. (shrink)

Richard Watson maintains that deep ecology suffers from an internal contradiction and should therefore be rejected. Watson contends that deep ecology claims to be non-anthropocentric while at the same time is committed to setting humans apart from nature, which is inherently anthropocentric. I argue that Watson’s objection arises out of a fundamental misunderstanding of how deep ecologist’s conceive of the ‘Self.’ Drawing on resources from Buddhism, I offer an understanding of the ‘Self’ that is fully consistent with deep ecology, and (...) does not lead to the anthropocentric contradiction that Watson identifies. The paper will proceed as follows: First, I articulate Watson’s objection, and briefly discuss the traditional deep ecology position. Next, I turn to a discussion of the ‘Self’ and show that there are conceptions of human nature that are not separate from ‘Nature.’ It will thus be shown that deep ecology is not inconsistent and need not be rejected. In recent decades, interest in non-monogamous intimate relationships has grown rapidly. Polyamory, relationship anarchy, consensual or ethical non-monogamy, and more have become popular in academic and public discourse. These practices destabilize the privileging of heterosexual nuclear families and the assumption that romantic coupledom is the ultimate form of love. Non-monogamous approaches flout cultural norms of exclusivity by avowing that intimacy is compatible with multiple dyadic and/or multi-party relationships. In the literature on assertion, there is a common assumption that having the knowledge that p is a sufficient condition for having the epistemic right to assert that p—call this the Knowledge is Sufficient for Assertion Principle, or KSA. Jennifer Lackey has challenged KSA based on several counterexamples that all, roughly, involve isolated secondhand knowledge. In this article, I argue that Lackey’s counterexamples fail to be convincing because her intuition that the agent in her counterexamples both has knowledge and do (...) not have the epistemic right to assert is wrong. The article will progress as follows: In section 2, I present Lackey’s argument. In section 3, I suggest some more general reasons for doubting that the agent in her counterexamples actually has knowledge. I then show that from a virtue theoretic and Edward Craig’s practical explication of knowledge perspectives the agent in Lackey’ s counterexamples does not know. Since the agent in Lackey’s counterexamples does not have knowledge, she has failed to convincingly prove that KSA is false. In section 4, I conclude by suggesting that, at most, what Lackey’s counterexamples demonstrate is a problem with a simplistic evidentialist and/or process reliabilist epistemology. (shrink)

In this article, I argue that mass incarceration belongs to a category of social status interventions by which the modern state either withholds the ordinary protections and benefits of the law from outlawed groups or subjects them to private punishment based on their mere membership in those groups. In the US these groups include immigrants and resident Latinos, the homeless, the poor and poor blacks, sex workers, and ex-convicts. Outlawry is a fundamentally anti-democratic practice that cannot be justified in terms (...) of deterrence and is incompatible with public safety. (shrink)

Many people do not know or believe there is a God, and many experience a sense of divine absence. Are these (and other) “divine hiddenness” facts evidence against the existence of God? Using Bayesian tools, we investigate *evidential arguments from divine hiddenness*, and respond to two objections to such arguments. The first objection says that the problem of hiddenness is just a special case of the problem of evil, and so if one has responded to the problem of evil then (...) hiddenness has no additional bite. The second objection says that, while hiddenness may be evidence against generic theism, it is not evidence against more specific conceptions of God, and thus hiddenness poses no epistemic challenge to a theist who holds one of these more specific conceptions. Our investigation leaves open just how strong the evidence from hiddenness really is, but we aim to clear away some important reasons for thinking hiddenness is of no evidential significance at all. In the Foundations of Mathematics, Ramsey attempted to amend Principia Mathematica’s logicism to meet serious objections raised against it. While Ramsey’s paper is well known, some questions concerning Ramsey’s motivations to write it and its reception still remain. This paper considers these questions afresh. First, an account is provided for why Ramsey decided to work on his paper instead of simply accepting Wittgenstein’s account of mathematics as presented in the Tractatus. Secondly, evidence is given supporting that Wittgenstein was not moved (...) by Ramsey’s objection against the Tractarian account of arithmetic, and a suggestion is made to explain why Wittgenstein reconsidered Ramsey’s account in the early thirties on several occasions. Finally, a reading is formulated to understand the basis on which Wittgenstein argues against Ramsey’s definition of identity in his 1927 letter to Ramsey. (shrink)

Discussions of sexual ethics often focus on the wrong of treating another as a mere object instead of as a person worthy of respect. On this view, the task of sexual ethics becomes putting the other’s subjectivity above their status as erotic object so as to avoid the harms of objectification. Ward and Anderson argue that such a view disregards the crucial, moral role that erotic objecthood plays in sexual encounters. Important moral features of intimacy are disclosed through the (...) experience of being an erotic object for another, as well as in perceiving another as an erotic object. Drawing on phenomenology, especially the insights of Simone de Beauvoir, Ward and Anderson argue that erotic encounters are shaped by the human condition of ambiguity, where being an object for others is intertwined with bodily agency. Because sexual agency is complex in this way, theories of sexual ethics and responsibility must widen their focus beyond transparent communication and authoritative expressions of will. (shrink)

In this paper, I offer an understanding of G.E. Moore’s epistemology as presented in, “A Defence of Common Sense” and “Proof of an External World”. To frame the discussion, I look to Roderick Chisholm’s essay, The Problem of the Criterion. I begin by looking at two ways that Chisholm believes one can respond to the problem of the criterion, and, referring back to Moore’s essays, explain why it is not unreasonable for Chisholm to believe that he is following a line (...) of reasoning that Moore might take. I then show why I believe Chisholm is actually trying to do something quite different from what Moore was, and thus misses Moore’s actual point. I conclude that Moore is best understood as rejecting traditional epistemological concerns. By forcing Moore to deal with a traditional epistemological problem, it will become clear how bold Moore’s “epistemology” is. (shrink)

We enjoy sounds. What about silence: the absence of sound? Certainly not all, but surely many of us seek out, attend to, and appreciate silence. But, if nothing is there, then there is nothing to possess aesthetic qualities that might engage aesthetic interest or reward aesthetic attention. This is at least puzzling, perhaps even paradoxical. In this paper, I attempt to dispel the sense of paradox and provide a way to understand aesthetic appreciation of silence. O objetivo do presente artigo é apresentar o conceito de “motivos básicos religiosos” no pensamento de Herman Dooyeweerd. Em primeiro lugar, será apresentado a concepção de religião em Dooyeweerd e, em seguida, serão apresentados o conceito e o desenvolvimento dos “motivos básicos religiosos” no pensamento ocidental. As conclusões do texto são que (...) esse conceito contribui em demonstrar que há uma dimensão tácita e comunitária na reflexão filosófica e que a impossibilidade de síntese teórica entre polos de “motivos básicos religiosos” imanentistas diz respeito à “dialética religiosa”. Objetiva-se expor o pensamento de Herman Dooyeweerd (1894-1977), prolífico jusfilósofo holandês, no que diz respeito à maneira como destaca o aspecto jurídico da realidade e formula sua concepção de enciclopédia da ciência do Direito. Problematiza-se em que medida a teoria dooyeweerdiana permite o desenvolvimento de um conceito de Direito relevante para a teoria da decisão judicial. Neste afã, após exposição sintética das bases de seu pensamento, verticaliza-se o estudo do aspecto jurídico da realidade e da noção-base de sua Enciclopédia da (...) Ciência do Direito. Explora-se a original perspectiva filosófica dooyeweerdiana sobre a positivação do direito e a interpretação jurídica, ambas limitadas seja pelo inafastável núcleo distintivo do aspecto jurídico (a retribuição), seja pelo dever de considerar o todo dos aspectos da experiência humana e das esferas sociais envolvidas. Conclui-se que o conceito de enciclopédia jurídica em Dooyeweerd, à luz de uma densa e intrigante filosofia cosmonômica, enriquece sobremaneira a clássica discussão jusfilosófica que envolve o papel do direito positivo e os limites da interpretação jurídica, na medida em que oferece valioso prisma integrativo do aspecto jurídico frente aos demais aspectos da experiência humana, colaborando para uma visão jurídica não reducionista, preservadora da irredutibilidade do Direito e conferidora de limites mais claros à decisão judicial. Cosmological arguments for God typically have two stages. The first stage argues for a first cause or a necessary being, and the second stage argues from there to God. T. Ryan Byerly offers a simple, abductive argument for the second stage where the best explanation for why the being is found to have necessary existence is that it is a perfect being. The reasoning behind this argument is that universal generalizations explain observations of their instances; for example, the universal generalization (...) that all ravens are black explains why some particular raven is observed to be black. Similarly, the fact that a being has all perfections explains why we find the being to have necessary existence. I distinguish between two readings of Byerly’s proposed theistic explanation, and conclude that his explanation does not offer an advantage to the theist in either case. (shrink)

Since the publication of the Remarks on the Foundations of Mathematics, Wittgenstein’s interpreters have endeavored to reconcile his general constructivist/anti-realist attitude towards mathematics with his confessed anti-revisionary philosophy. In this article, the author revisits the issue and presents a solution. The basic idea consists in exploring the fact that the so-called “non-constructive results” could be interpreted so that they do not appear non-constructive at all. The author substantiates this solution by showing how the translation of mathematical results, given by the (...) possibility of translation between logics, can be seen as a tool for partially implementing the solution Wittgenstein had in mind. Memphis Elvis is cool; Vegas Elvis is cheesy. How come? To call something cheesy is, ostensibly, to disparage it, and yet cheesy acts are some of the most popular in popular culture today. How is this possible? The concepts of cheese, cheesy, and cheesiness play an important and increasingly ubiquitous role in popular culture today. I offer an analysis of these concepts, distinguishing them from nearby concepts like kitchy and campy. Along the way I draw attention to the important roles (...) of cultural/historical context, background knowledge, and especially artist’s intentions as they are relevant to aesthetic assessments involving cheese and related concepts. I go on to contend that these concepts, properly understood, serve as helpful test cases concerning some important issues in contemporary aesthetics, such as the paradox of negative art and the contentious debate between intentionalists and anti-intentionalists. Alvin Plantinga has famously argued that the naturalist who accepts evolutionary theory has a defeater for all of her beliefs, including her belief in naturalism and evolution. Hence, he says, naturalism, when conjoined with evolution, is self defeating and cannot be rationally accepted. This is known as the evolutionary argument against naturalism (EAAN). However, Tyler Wunder (Religious Studies 51:391– 399, 2015) has recently shown that if the EAAN is framed in terms of objective probability and theism is assumed to be (...) non-contingent, then either theism is necessarily false or the EAAN is unsound. Neither option is attractive to the proponent of the EAAN. Perry Hendricks (Religious Studies 1–5, 2018) has responded to Wunder’s criticism, showing that the EAAN can be salvaged and, indeed, strengthened, by framing it in terms not of naturalism (N), but of a proposition that is entailed by N that is also consistent with theism. We will show that once Hendricks’ solution to Wunder’s objection is accepted, a puzzle ensues: if the EAAN provides the naturalist with a defeater for all of her beliefs, then an extension of it appears to provide God with a defeater for all of his beliefs. After bringing out this puzzle, we suggest several ways in which the proponent of the EAAN might solve it, but also show some potential weaknesses in these purported solutions. Whether the solutions to the puzzle that we consider ultimately succeed is unclear to us. (Translation: the authors disagree. One author thinks that the solutions (or,at least, some of them) that we consider do solve the puzzle while the other author does not.) Whiteness theorists argue that whiteness has two essential features. First, whiteness colonizes, appropriates and controls the Other. Whiteness is, then, racist.Second, whiteness is constructed unwittingly. Whites are, it is claimed, unaware of the harms they inflict on a genocidal scale because whiteness, like the air we breathe, is “invisible” to those who construct it and are constructed by it. Whiteness is, then, innocent. I think defining whiteness as innocent racism is troubling for two reasons. First, it leaves whites unaccountable for (...) the acts of racism they perpetuate. Second, I think that the claim that whiteness is invisible “like the air we breathe,” while a powerful and fascinating metaphor, is mistaken. I will argue that whiteness is closeted; and while the closet makes the acknowledgement of whiteness difficult, it does not make it impossible. Thus, though closeted, whites are morally accountable for the acts of racism they commit. (shrink)

A crucial objection to the doctrine of original sin is that it conflicts with a common intuition that agents are morally responsible only for factors under their control. Here, I present an account of moral responsibility by Michael Zimmerman that accommodates that intuition, and I consider it as a model of original sin, noting both attractions and difficulties with the view.

In this article I seek to come to some understanding of the interlocutors in the first book of Plato’s Republic, particularly Cephalus. A more complete view of Cephalus not only provides some interesting ways to think about Plato and the Republic, but also suggests an interesting alternative to Plato’s view of justice. The article will progress as follows: First, I discuss Plato’s allegory of the cave. I, then, critique the cave allegory by applying the same kind of reasoning that O. (...) K. Bouwsma used to criticize Descartes’ evil genius. Next, I present what I think is a fruitful way to understand Cephalus. Finally, I draw some important conclusions regarding justice and offer some interesting critiques of Plato and Platonism. (shrink)

I identify a commonly held position in environmental philosophy, “the received view,” and argue that its proponents beg the question when challenged to demonstrate the relevance of environmental aesthetics for environmental justice. I call this “the inference problem,” and I go on to argue that an alternative to the received view, Arnold Berleant’s participatory engagement model, is better equipped to meet the challenge it poses. By adopting an alternative metaphysics, the engagement model supplies a solution to the inference problem and (...) thereby provides a more useful theoretical framework for application to pressing concernsin environmental justice, such as the plight of the historical Ironbound District of Newark, New Jersey. This article argues that postwar Seventeen magazine, a publication deeply invested in enforcing heteronormativity and conventional models of girlhood and womanhood, was in fact a more complex and multivocal serial text whose editors actively sought out, cultivated, and published girls’ creative and intellectual work. Seventeen's teen-authored “Curl Up and Read” book review columns, published from 1958 through 1969, are examples of girls’ creative intellectual labor, introducing Seventeen's readers to fiction and nonfiction which ranged beyond the emerging “young-adult” literature of the (...) period. Written by young people – including thirteen-year-old Eve Kosofsky (later Sedgwick) – who perceived Seventeen to be an important publication venue for critical work, the “Curl Up and Read” columns are literary products in their own right, not simply juvenilia. Seventeen provided these young authors the opportunity to publish their work in a forum which offered girl readers and writers opportunities for intellectual development and community. (shrink)

In this paper we offer a new argument for the existence of God. We contend that the laws of logic are metaphysically dependent on the existence of God, understood as a necessarily existent, personal, spiritual being; thus anyone who grants that there are laws of logic should also accept that there is a God. We argue that if our most natural intuitions about them are correct, and if they are to play the role in our intellectual activities that we take (...) them to play, then the laws of logic are best construed as necessarily existent thoughts -- more specifically, as divine thoughts about divine thoughts. We conclude by highlighting some implications for both theistic arguments and antitheistic arguments. (shrink)

O quarto volume da obra "Ordem e História" de Eric Voegelin, intitulado de "A Era Ecumênica", marca a última mudança no pensamento do filósofo alemão. Voegelin rejeita uma concepção linear da história e sugere que as "irrupções espirituais" das civilizações se tornem o objeto de análise para identificar a "ordem da história". A partir disso, Voegelin rejeita os sistemas imanentistas da modernidade, notadamente, ideologias, como "revoltas egofânicas" que trazem desequilíbrio no Intermédio ou "metaxia" entre o cosmos e o além. O (...) objetivo do presente artigo é identificar a concepção de história e a crítica às ideologias modernas na obra "A Era Ecumênica" de Eric Voegelin. Adota-se metodologia exploratória e abordagem qualitativa na investigação do objetivo proposto. O trabalho conclui que, apesar da importante crítica voegiliniana à perda de fundamento transcendente da política moderna, a filosofia política do "último Voegelin" de "A Era Ecumênica" tem pouco a dizer sobre a política concreta, revelando-se uma filosofia da consciência apolítica em sentido normativo. Busca-se apresentar a leitura de MacIntyre sobre o emotivismo moral presente no último capítulo de A Short History of Ethics, suas críticas a essa concepção ética nos capítulos dois e três de After Virtue, os argumentos de Bruce Waller e Nicholas Unwin em defesa de uma reformulação do emotivismo moral e as críticas (...) de John Lemos a essa sugestão. Espera-se que o texto contribua na apresentação dos principais argumentos do debate entre MacIntyre e o emotivismo moral, a fim de servir de orientação para outras discussões na área da metaética. I argue that silence is replete with aesthetic character and that it can be a rewarding object of aesthetic appreciation, assessment, and appraisal. The appreciation of silence might initially seem impossible, for, it might seem, there is nothing there to behold. Taking up this challenge, I attempt to dispel the sense of paradox. I contend that, despite our never actually experiencing absolute silence, there is much to enjoy in the silences that we do experience. I go on to argue that (...) proper appreciation of silence is a two-way street, involving quiet on the outside and stillness on the inside. I conclude by offering some suggestions for how to make the aesthetic appreciation of silence part of a flourishing life. (shrink)

Do psychological traits predict philosophical views? We administered the PhilPapers Survey, created by David Bourget and David Chalmers, which consists of 30 views on central philosophical topics (e.g., epistemology, ethics, metaphysics, philosophy of mind, and philosophy of language) to a sample of professional philosophers (N = 314). We extended the PhilPapers survey to measure a number of psychological traits, such as personality, numeracy, well-being, lifestyle, and life experiences. We also included non-technical ‘translations’ of these views for eventual use in other (...) populations. We found limited to no support for the notion that personality or demographics predict philosophical views. We did, however, find that some psychological traits were predictive of philosophical views, even after strict correction for multiple comparisons. Findings include: higher interest in numeracy predicted physicalism, naturalism, and consequentialism; lower levels of well-being and higher levels of mental illness predicted hard determinism; using substances such as psychedelics and marijuana predicted non-realist and subjectivist views of morality and aesthetics; having had a transformative or self-transcendent experience predicted theism and idealism. We discuss whether or not these empirical results have philosophical implications, while noting that 68% of our sample of professional philosophers indicated that such findings would indeed have philosophical value. Herman Dooyeweerd (1894-1977) foi um filósofo neerlandês que, em diálogo com a filosofia alemã e o pensamento neocalvinista, desenvolveu uma reflexão original sobre as leis e a ordem do cosmos. A filosofia de Dooyeweerd é conhecida como “Filosofia da Ideia de Lei” ou “Filosofia da Ideia Cosmonômica”. A partir de sua teoria modal – que identifica quinze aspectos ônticos em que coisas concretas, eventos, relações e esferas sociais funcionam ou existem – Dooyeweerd desenvolveu uma filosofia político-social crítica às teorias sociais (...) individualistas e universalistas. O problema da presente pesquisa é: que objeto teórico caracteriza a filosofia político-social de Herman Dooyeweerd? A hipótese de investigação é que a preocupação político-social dooyeweerdiana diz respeito ao “problema da ordem”, i.e., a identificação teórica da ordem político-social nos limites das normas transcendentais divinas. O objetivo é analisar a concepção de Herman Dooyeweerd sobre a ordem político-social. Argumenta-se que a filosofia política de Dooyeweerd nem é nem se preocupa em ser comunitarista. O interesse de Herman Dooyeweerd é apreender teoricamente, a partir da análise da estrutura dos modos de experiência, quais são os princípios, as estruturas, as funções e a natureza das coisas, dos eventos e das relações e esferas sociais. Dooyeweerd busca compreender a estrutura típica de cada relação social, a fim de compreender os princípios de uma ordenação política plural e harmoniosa. Conclui-se que a preocupação da filosofia político-social de Herman Dooyeweerd é a compreensão da ordem dentro dos parâmetros cosmonômicos da criação divina. (shrink)

Recent accounts of coercion can be mapped onto two different axes: whether they focus on the situation of the coercee or the activities of the coercer; and whether or not they depend upon moral judgments in their analysis of coercion. Using this analysis, I suggest that almost no recent theories have seriously explored a non-moralized, coercer-focused approach to coercion. I offer some reasons to think that a theory in this underexplored quadrant offers some important advantages over theories confined to the (...) other quadrants. In particular I suggest that much of our interest in coercion depends on facts about the coercer, such as the sorts of powers coercers must possess to be able to coerce, and on the coercer's intention in using those powers to constrain or alter the coercee's activities. According to the most popular theories of intentionality, a family of theories we will refer to as “functional intentionality,” a machine can have genuine intentional states so long as it has functionally characterizable mental states that are causally hooked up to the world in the right way. This paper considers a detailed description of a robot that seems to meet the conditions of functional intentionality, but which falls victim to what I call “the composition problem.” One obvious way to escape (...) the problem (arguably, the only way) is if the robot can be shown to be a moral patient – to deserve a particular moral status. If so, it isn’t clear how functional intentionality could remain plausible (something like “phenomenal intentionality” would be required). Finally, while it would have seemed that a reasonable strategy for establishing the moral status of intelligent machines would be to demonstrate that the machine possessed genuine intentionality, the composition argument suggests that the order of precedence is reversed: The machine must first be shown to possess a particular moral status before it is a candidate for having genuine intentionality. Introdução: Hans Kelsen (1881-1973), juspositivista austríaco, e Herman Dooyeweerd (1894-1977), jusfilósofo neerlandês, foram pensadores contemporâneos que presenciaram o avanço do poder totalitário do Estado expresso por meio de normas jurídicas. Ambos se preocuparam em discutir sobre a relação entre Estado e direito, mas se afastaram na formulação de suas jusfilosofias: Kelsen defendeu uma concepção em que o Estado se tornou a personificação da ordem jurídica, Dooyeweerd distinguiu o direito da estrutura do Estado. Objetivo: analisar os comprometimentos teóricos e os problemas (...) político-jurídicos do pensamento de Hans Kelsen a partir da filosofia de Herman Dooyeweerd. Problemáticas: 1) A relação entre Estado e direito em Hans Kelsen é incapaz de proteger a sociedade civil e os indivíduos do poder do Estado, como afirmam os jusnaturalistas?; 2) Toda filosofia que postula princípios normativos limitadores à produção do direito é uma metafísica atemporal que resulta em uma concepção política antipluralista, como defende Hans Kelsen?. Hipóteses: 1) Jusnaturalistas estão corretos ao afirmarem que a Teoria Pura do Direito de Kelsen possibilita um ilimitado poder ao ente estatal face à sociedade civil, sendo incapaz de oferecer-lhe subsídios teóricos para sua proteção; 2) Kelsen não está certo ao entender que toda filosofia que postula princípios normativos limitadores à produção do direito é uma metafísica atemporal que resulta em uma concepção política antipluralista. Justificativas da pesquisa: 1) Analisa, a partir da crítica transcendental dooyeweerdiana, se os compromissos assumidos por Kelsen acerca da realidade o levaram a uma teoria reducionista capaz de tornar a sociedade desprotegida diante do poder do Estado; 2) Investiga se a teoria dooyeweerdiana tem capacidade de superar a tópica jusnaturalismo e juspositivismo. Resultados: 1) Como alegam os jusnaturalistas, a perspectiva política e jurídica de Kelsen, que reduz o direito ao aspecto lógico e delega as discussões de justiça ao âmbito político, não possibilita à sociedade uma proteção jurídica ao poder normativo do Estado; 2) A concepção político-jurídica dooyeweerdiana demonstra ser possível uma filosofia que encontra princípios limitadores à produção do direito na ordem da realidade e reconhece a pluralidadesocial devido à abertura da experiência histórica. Conclusão: sociedades democráticas profundamente polarizadas precisam descobrir normas objetivamente dispostas na realidade capazes de gerar consenso político e positivação legitimada, não por uma metafísica atemporal ou pela vontade impositiva de uma elite, mas pelo reconhecimento de que há uma ordem capaz de gerar mais benefícios para o bem comum. Esse livro é uma introdução ao pensamento de Abraham Kuyper. O texto se destina àqueles que desejam começar a compreender o pensamento de Kuyper. A primeira parte do livro se dedica à vida e obra de Kuyper, como também à sua articulação do calvinismo como um sistema de vida e pensamento todo abrangente. Na segunda unidade, apresenta-se a relação feita por Kuyper entre calvinismo, ciência e filosofia política. Por fim, na última unidade, expõe-se a articulação entre calvinismo, cultura e artes. (...) Esse livro, resultado de minhas pesquisas no Mestrado de Filosofia da Universidade Federal da Paraíba, apresenta e discute a perspectiva teórica dooyeweerdiana sobre a ordem de uma sociedade complexa. A filosofia de Herman Dooyeweerd pode contribuir para a reflexão e ação cristã em uma sociedade moderna e plural. Em Dooyeweerd, é possível encontrar uma teoria política e social abrangente para pensar e atuar no ambiente público, rejeitando orientações (...) ideológicas secularistas. Herman Dooyeweerd pode nos ajudar a refletir sobre política e sociedade na medida em que nos faz reconhecer princípios estruturais na realidade criada por Deus que estruturam cada esfera e relação social em seu âmbito de soberania. Em contraponto ao positivismo e ao historicismo, Dooyeweerd nos indica caminhos para compreender as normas divinas para cada centímetro quadrado da existência. Além de denunciar o comprometimento religioso do imanentismo das ideologias políticas, Dooyeweerd tem muito a dizer sobre como pensar política e sociedade na ordem da história. (shrink)

Several prominent theorists have recently advocated reconceptualizing rape as “nonconsensual sex,” omitting the traditional “force” element of the crime. I argue that such a conceptualization fails to capture what is distinctively problematic about rape for women and why rape is pivotal in supporting women’s gender oppression. I argue that conceptualizing rape as coerced sex can replace both the force and nonconsent elements and thereby remedies some of the main difficulties with extant definitions, especially in recognizing “acquaintance” rape as such. In this chapter, I describe my “post-diagnosis” experiences as the parent of an autistic child, those years in which I tried, but failed, to make sense of the overwhelming and often nonsensical information I received about autism. I argue that immediately after being given an autism diagnosis, parents are pressured into making what amounts to a life-long commitment to a therapy program that (they are told) will not only dramatically change their child, but their family’s financial situation and even their (...) entire mode of existence. Moreover, despite information overload, many treatment programs for autism rely on empty jargon and make completely unrealistic promises, so parents are left feeling overwhelmed and panicked. Even well respected therapy programs encourage parents to spend liberally. Indeed, autistic therapists, who help construct what I refer to as the Culture of Autism, advise parents to commit to a minimum of 35 to 45 hours of intensive therapy every week. The implications are clear: for a parent who works full-time, their autistic child becomes a second full-time job. Autism is big business right now, and therapists are pushing parents to the brink of desperation. So it is not too surprising that there is a desperate cry for a more permanent solution—which is why researchers seek to cure autism. But there are two ways to conceptualize cure. A Therapeutic Cure model (TC) conceives of a cure as a beneficial treatment for the patient that eliminates or ameliorates the harms of the disease or condition. But the notion of a therapeutic cure for autism is highly implausible, given the complexities of autism. Indeed, at this point, the vast majority of researchers have come to the conclusion that the idea of a therapeutic cure for autism is simply a non-starter. Therefore the bulk of research seeking a cure for autism focuses instead on a second approach, which I refer to as the Negative Eugenics Cure model (NEC). With this model, the intention is to eliminate the disease or condition without regard for the health or well-being of the organism carrying the disease or condition. So, with regard to autism, researchers are focusing on identifying genetic markers for autism that can be detected in utero, or in embryos, so that autistic fetuses can be eliminated and autism eradicated by preventing the existence of autistic individuals. I review both models and argue that both fail to provide convincing arguments that the “solution” either offers is desirable. Both rest on the assumption that autism renders a life not worth living which, all things considered, is false. Instead of pushing to cure autism, an idea pervasive in this Culture of Autism, I contend that autistics are individuals with lives worth living. Moreover, rather than expend millions on research to search for the means to eliminate autism, we should instead expend our resources to ensure autistic individuals have access to support they may need. If the phenomenology of autism were better understood and appreciated, the panicked demand for a cure for autism might abate and perhaps autism could be seen as having value in and of its own right. A plausible explanation of the wrongfulness of threatening, advanced most explicitly by Mitchell Berman, is that the wrongfulness of threatening derives from the wrongfulness of the act threatened. This essay argues that this explanation is inadequate. We can learn something important about the wrongfulness of threatening (with implications for thinking about coercion) by comparing credible threats to some other claims of impending harm. A credible bluff threat to do harm is likely to be more and differently wrongful than making intentionally (...) false warnings about other sources of harm. This essay surveys some examples to secure this point, shows that Berman's moralized account of their wrongfulness is wanting, and offers the outline of an approach better suited to explain the wrongfulness of threatening.1. Virtual environments engage millions of people and billions of dollars each year. What is the ontological status of the virtual objects that populate those environments? An adequate answer to that question requires a developed semantics for virtual environments. The truth-conditions must be identified for “tree”-sentences when uttered by speakers immersed in a virtual environment (VE). It will be argued that statements about virtual objects have truth-conditions roughly comparable to the verificationist conditions popular amongst some contemporary antirealists. This does not mean (...) that the virtual objects lack ontological standing. There is an important sense in which virtual objects are no less real for being mind-dependent. (shrink)

In The Idea of Justice, Amartya Sen, among other things, discusses certain qualities any adequate theory of justice ought to incorporate. Two important qualities a theory of justice should account for are impartiality/objectivity and sensitivity to consequences. In order to motivate his discussion of sensitivity to consequences, Sen discusses the debate between Krishna and Arjuna from the religio-philosophical Hindu text the Bhagavad Gita. According to Sen, Arjuna represents a sensitivity to consequences while Krishna is an archetypal deontologist. In this paper (...) it will be argued that Sen's interpretation of the Gita is inaccurate. Further, a more adequate interpretation will be presented. What will be of significance is that the more adequate interpretation actually demonstrates the importance of an impartial spectator in moral reasoning. Finally, there will be a discussion of some lessons that can be taken from the Gita regarding justice generally. (shrink)

O presente artigo examina os desafios éticos envolvidos no uso da inteligência artificial (IA) no sistema de justiça criminal. Inicialmente, a IA foi celebrada por suas promessas de aprimorar a elucidação de crimes e a criminologia preditiva, mas casos de aplicação equivocada e reforço de preconceitos levantam questões importantes. Para este artigo, utilizamos uma revisão bibliográfica qualitativa, analisando casos práticos e estudos acadêmicos relevantes para destacar os desafios e as implicações éticas do uso de IA no sistema de justiça criminal. A bibliografia foi escolhida por seu rigor acadêmico e sua relevância atual, abordando tanto os sucessos quanto os fracassos da IA, além de fornecer uma visão crítica sobre os vieses e as consequências sociais do uso dessas tecnologias. There have been many attempts to retire dualism from active philosophic life, replacing it with something less removed from science, but we are no closer to that goal now than fifty years ago. I propose breaking the stalemate by considering marginal perspectives that may help identify unrecognized assumptions that limit the mainstream debate. Comparison with Whitehead highlights ways that opponents of dualism continue to uphold the Cartesian “real distinction” between mind and body. Whitehead, by contrast, insists on a conceptual distinction: (...) there can no more be body without mind than mind without body (at least at the level of ultimate constituents). Key to this integration is Whitehead’s understanding that mind, at its most rudimentary, is simply the intrinsic temporality of a physical event. Thus, the resulting form of “panpsychism” is more naturalistic than commonly supposed, and it solves both the composition problem (traditionally fatal to panpsychism) and the “hard problem.”. From the outset, critical social theory has sought to diagnose people’s participation in their own oppression, by revealing the roots of irrational and self-undermining choices in the complex interplay between human nature, social structures, and cultural beliefs. As part of this project, Ideologiekritik has aimed to expose faulty conceptions of this interplay, so that the objectively pathological character of what people are “freely” choosing could come more clearly into view. The challenge, however, has always been to find a way of (...) doing this without arrogantly assuming special access to what is good for people. And this danger of paternalism is one to which social theorists have all too often fallen prey. In this brief essay, I focus on contemporary instances of clearly self-defeating behavior in contexts of complex choices. I begin by discussing a recent attempt to diagnose and solve these failures of choices, namely the public policy recommendations of behavioral economist Richard Thaler and reform-minded legal theorist Cass Sunstein. Their influential “libertarian paternalist” approach is particularly interesting, both in what it includes (attention to the socially constructed nature of choice situations and the roots of the problems in human nature) and in what it leaves out (an understanding of the social construction of human nature and an adequate appreciation of the value of autonomy). After discussing it, I consider a broadly perfectionist alternative, to the effect that the problem lies in a failure to adequately appreciate the importance of developing autonomy. I then turn to sketching the outlines of a new approach, based on the concept of “autonomy gaps,” which approaches overly demanding policies in relational and action-theoretical terms. In the final section, I show how this provides the basis for an analysis both in terms of a critique of ideology and of social pathology. (shrink)

In this article, I suggest that moksha (liberation or enlightenment) in Advaita Vedanta is best understood psychologically. A psychological understanding is not only consistent with the Advaita Vedanta articulated by Shankara and Gaudapada, but avoids what will be called the problem of jivan mukti. This article will consist of three main parts. First, I will briefly discuss the metaphysics and ontology of Advaita Vedanta. Next, I will present the problem of jivan mukti, and the Advaitin response to the problem. The (...) problem of jivan mukti will lead to the third portion of the article, which is a presentation of what moksha is. At no point in the article will I be arguing the truth of the Advaitin position. Instead, I will be meeting Advaita on its own terms in order to come to some understanding of moksha. (shrink)

Cross-cultural comparisons face several methodological challenges. In an attempt at resolving some such challenges, Nathan Sivin has developed the framework of “cultural manifolds.” This framework includes all the pertinent dimensions of a complex phenomenon and the interactions that make all of these aspects into a single whole. In engaging with this framework, Anna Akasoy illustrates that the phenomena used in comparative approaches to cultural and intellectual history need to be subjected to a continuous change of perspectives. Writing about comparative history, (...) Warwick Anderson directs attention to an articulation between synchronic and diachronic modes of inquiry. In addition, he asks: If comparative studies require a number of collaborators, how does one coordinate the various contributors? And how does one ensure that the comparison is between separate entities, without mutual historical entanglement? Finally, how does comparative history stack up against more dynamic approaches, such as connected, transnational, and postcolonial histories? Gérard Colas, for his part, claims that comparisons cannot allow one to move away from the dominant Euroamerican conceptual framework. Should this indeed be the case, we should search for better ways of facilitating a “mutual pollination” between philosophies. Finally, Edmond Eh first asserts that Sivin fails to recognize the difference between comparisons within cultures and comparisons between cultures. He then argues that the application of generalism is limited to comparisons of historical nature. (shrink)
